Job Search Tips

For those wondering where to begin your job search, Martindale.com is a great place. If you are looking for firms, you can narrow the scope by practice area and city; if you are looking for individuals, you can further that scope by law school/university attended. The WSBA directory also lets you search for attorneys by practice area and city. It doesn't list the individual's employer though, so it is more of a cumbersome search. But it could be a great starting point if you are interested in working in a smaller city or town.

KPMG Job Postings

KPMG has decided to recruit for their State and Local Tax Group, which I just posted. The interview date for SALT is to be determined; ICS interviews will be held on Tuesday, February 7 and will be conducted by Jason Knight. KPMG will notify candidates directly about their interview schedule.

Washington State DOR Position

The following position was posted on the WSBA website:

Washington State Department of Revenue — tax policy specialist 2 (NB 2011-09651). Opens December 5, 2011. Closes December 22, 2011.

Required qualifications: Admission to practice law in the state of Washington; or graduation from an accredited school of law and current admission to practice before the highest court of a state, and a minimum of one year as a tax policy specialist 1; or a minimum of two years’ experience as hearings examiner in a governmental agency, assistant attorney general, or practice as an attorney. A LL.M. or master’s degree in taxation or closely allied field will substitute for one year of experience.

Primary duties: This position is primarily responsible for conducting independent administrative hearings on the record for the review of the department’s initial orders to deny, revoke, or refuse to reinstate reseller permits, and review of initial orders revoking certificates of registration, and for entering final orders in accordance with the Administrative Procedures Act (APA). As an attorney trained in interpreting and applying tax law and policy, this position is responsible for reviewing, hearing, and resolving taxpayers’ appeals of department actions and responding to taxpayers’ petitions in writing. The appeal process provides taxpayers with a review of departmental actions, and produces decision articulating the department’s position, as mandated by statute. When applicable, this position may also resolve appeals through negotiation and settlement.

Compensation: $4296 - $5639 per month (Range 61), depending on qualifications. Outstanding benefits include: health, dental, life and long-term disability insurance; vacation, sick, military, and civil leave; dependent care assistance program; employee assistance program; deferred compensation plans; 11 paid holidays; training; and state retirement plans. For those of you who have taken tax exams before, please be aware that we will no longer be providing blue books and CDs to take exams. If you plan to use a bluebook or CD, be sure you purchase your own and bring them to your exams with you.

Fifth Annual Paul Faherty Tax Law Writing Competition



Award: $3,000 (grand prize); $1,000 (two honorable mentions)
Deadline: April 15, 2012
Eligibility
All JD and LLM candidates currently attending an ABA-accredited law school in the U.S. may enter. Entries will be evaluated on topic selection, analysis, quality of research, grammar, spelling, usage and syntax, clarity, structure, and overall appearance.
Topic
Any topic on tax law is acceptable, although papers on a public policy issue, a critique of a leading case or doctrine, a comment on a statute or the need for statutory modification, or a comment on a common law doctrine are encouraged.
Rules
Submitted papers must be the applicant's original work. Applicants are limited to one entry; multiple entries are expressly prohibited. Additionally, the paper must not be under consideration for any other publication or written as part of paid employment.
Specifications
Papers should be typed double-spaced, set in Times New Roman on letter-sized paper with one-inch margins on all sides. Entries should be formatted with endnotes and be 25-30 pages long, not including endnotes. Papers submitted with footnotes will not be accepted. Citations must conform to The Bluebook: A Uniform System of Citation.

Job Summary:
Guidant Financial’s Operations Department is seeking a licensed attorney who has a demonstrated interest and experience in tax and ERISA matters. Primary Responsibilities:
• The Assistant General Counsel (AGC) will work primarily with the organization’s recordkeeping department to ensure that Guidant’s clients operate their 401(k) plans in compliance of IRS and ERISA rules and regulations.
• Will provide legal support to the recordkeepers to address federal tax and ERISA issues on a daily basis.
• Review client’s file to ensure operation within our structure’s guidelines, ERISA and tax laws, and review recordkeeping annual reports and testing results along with the Form 5500 for accuracy.
• Draft certain 401(k) plan documents and amendments to the 401(k) plan as clients’ request.
• Maintain current knowledge and understanding on regulatory guidelines surrounding Guidant’s products and/or services
• Perform research on law or regulatory changes as they affect Guidant’s clients, products or services.
• Provide other legal duties and responsibilities as needed by Senior Counsel or Assistant General Counsel and the business
• Work with Guidant’s outside counsel on various client topics and/or corporate initiatives
• Support internal sales team and other teams within the organization

Experience/Education
Juris Doctorate degree plus a minimum of 2+ years experience with tax and/or ERISA law.

The candidate must be licensed and in good standing with a state bar association, preferably with the Washington State Bar Association.

Qualifications
• Experience with 401(k) plan non-discrimination testing, plan testing failures and corrections, and various IRS plan correction methods preferred.
• Must be able to multi-task and establish priorities for yourself and others based on workload and departmental needs
• Must be able to work well under pressure and be comfortable in a fast-paced and ever-changing environment
• Excellent verbal and written communication skills
• Computer proficiency with experience using the Microsoft Office applications.
• Must be meticulous and detail-oriented.

John Price Scholarships and 56th Annual Estate Planning Seminar

On October 31 and November 1, the Estate Planning Council of Seattle and the Washington State Bar Association will sponsor the 56th Annual Estate Planning Seminar. This is the second largest estate planning seminar in the country, with over 1,000 in attendance each year. If you would like a copy of the brochure for this year's program, please let me know. I strongly encourage those of you interested in a career as an estate planner to attend this conference. It is a great opportunity to network with potential employers and the substance of the program is top-notch.

The Washington State Bar Association is offering three "John Price Scholarships" to three students enrolled in the UW Graduate Program in Taxation. These scholarships, named after Professor John Price, a former Dean of the School of Law and a world-renowned estate planner, offer complimentary admission to the conference together with a complimentary set of course materials for the entire program. Lunch is not included with these scholarships.

If you would like to be considered for one of the John Price Scholarships, please send me an email (hla3@uw.edu) as soon as possible. If more than three students indicate interest prior to 5:00 p.m. on Wednesday, October 5, there will be a lottery to award the scholarships. The results of any such lottery will be announced on Thursday, October 6. Winners will be expected to submit information to claim the scholarship by Friday, October 7.

Resume Workshop - Friday, October 7

Holly Bennet, with the law school's Center for Professional and Leadership Development (CPLD), will be conducting a resume workshop for LL.M. students this Friday from 10:30 a.m. - 12:30 p.m. This will be an interactive workshop where you work with the other students on your resume. Prior to the workshop, you will need to upload your resume into Symplicity and review the sample resumes on the CPLD's website: https://www.law.washington.edu/Career/Students/ApplicationMaterials.aspx. Space is limited, so if you plan to attend, please let me know as soon as possible, but no later than 5 p.m. on Wednesday.

Please remember that I am always available to review your resumes and cover letters. The other LL.M. programs do not have a dedicated career counselor outside of the CPLD, so this is their first step before meeting with a career counselor. But it is open to tax students as well.

Rural Alaska Tax Assistance Program 2011-12

Description: A tax assistance training program culminating in a ten day service trip in late February to remote Alaskan villages to provide tax advice, counseling, and preparation services to local residents and fisherman. As part of the training you will obtain the IRS's VITA tax preparation certification as well as additional subject specific endorsements. Participation requires a commitment of 4-6 hours per week in December, January, and February, and a willingness fly in bush planes, sleep on the floor (probably heated, but no promises), and prepare your own food on the ten day service trip to Alaska in in frigid February conditions.

Georgetown University Law Center Clinical Teaching Fellowships

Georgetown University Law Center is pleased to announce the availability of up to 16 clinical graduate fellowships commencing in the summer of 2012. Georgetown Graduate Clinical Teaching Fellowships offer new and experienced attorneys the opportunity to combine study with practice in the fields of clinical legal education and public interest advocacy.

Each fellowship is associated with one of the Law Center's clinical programs, and each program varies in purpose, requirements, and duties.
All of the clinical fellowships, however, share a common goal: to provide highly motivated lawyers the chance to develop skills as teachers and legal advocates within an exciting and supportive educational environment. Graduates of Georgetown's clinical fellowship program have gone on to a wide variety of positions in law teaching and public interest law settings. Well over 100 Georgetown fellows are now teaching at law schools across the country, including five Deans of law schools and several Associate Deans or Directors of clinical programs.
Many others are leaders in the public interest arena.

Fellows enroll in a two-year program during which they are in residence at a Georgetown clinic. Fellows directly supervise J.D. students enrolled in the clinics, assist in teaching clinic seminars, and perform work on their own cases or other legal matters. Fellowships usually begin in the late summer, with an intensive orientation designed to introduce fellows to clinical teaching methods. The orientation is part of our Elements of Clinical Pedagogy course, a year-long teacher training program. Upon completing the requirements for graduation, fellows are awarded the degree of Master of Laws (Advocacy). We are currently seeking fellows to work in the following areas: appellate litigation; civil rights; communications law; criminal defense; domestic violence; environmental law; federal legislation; HIV/AIDS law, housing and community development; juvenile delinquency; trade policy and health care policy; and political asylum.

The fellowship program currently offers an annual stipend of approximately $53,000 (taxable), plus all tuition and fees in the LL.M. program. Health insurance and other benefits are also provided. As graduate students, fellows are eligible for deferment of their student loans during their two years in the fellowship. They may also be eligible for their law school=s loan repayment assistance program.

With the exception of fellows in the Center for Applied Legal Studies and the Street Law Program, all fellows must be members of the D.C. bar. Fellowship applicants who are admitted to a bar elsewhere must apply to waive into the D.C. bar upon accepting their fellowship offer. The Law Center will reimburse the expense of waiving into the D.C. bar incurred by those fellows who have already taken the bar exam elsewhere prior to accepting their fellowship offer.

Applications must be sent directly to the director of the clinic or program in which the fellowship is sought and not to the Graduate Programs Admissions Office. Application deadlines vary by fellowship.

FBA Section on Taxation Writing Competition

The FBA Section on Taxation would like to announce the 2012 Donald C. Alexander Writing Competition.

Requirements are as follows: Full and part-time J.D. and LL.M. students are eligible. Any original paper concerning federal taxation between 20-50 double spaced pages is welcome. Seminar papers and articles submitted (but not yet selected for publication) to law reviews, journals, or other competitions are eligible. Winning authors receive $2000 (first place) or $1000 (second place) and a trip to the FBA’s Annual Tax Law Conference, Washington, D.C. The winning entries may be published in the Tax Section newsletter the Report or in The Federal Lawyer.

KPMG Recruiting

For the past couple of years, KPMG has recruited in the fall for State and Local Tax and in the winter for International Corporate Services. This year, however, they have decided to consolidate their recruiting, so they will interview for both SALT and ICS in winter quarter. They will, however, still come on campus to talk with the students on September 27. Please join Dean Testy for a Dean’s Roundtable on Thursday, May 12th at 12:30pm in Room 133, for a rare opportunity to hear from Ms. Eileen O’Connor, who served within the U.S. Department of Justice for six years as Assistant Attorney General for the Tax Division and who is the wife of our inaugural Shefelman Jurist-in-Residence, the Honorable A. Raymond Randolph. During the roundtable, Ms. O’Connor will give a talk titled “The Use and Abuse of the Internal Revenue Code” and will answer questions from the audience.

The following provides an abstract of the talk she will give at the roundtable: The purpose of the Internal Revenue Code is to raise revenue. But lawmakers also use the tax laws to reward and punish economic and social behavior, to curry favor with interest groups, and to persuade their supporters they are doing something to address their concerns. A survey of recent tax legislative proposals will illustrate these points. And a quick review of recent tax law changes will demonstrate the disastrous consequences that, while unintended, were certainly not unforeseeable.


Ms. O’Connor is a partner in the Washington, DC office of Pillsbury, and leader of the firm’s federal tax controversy and tax policy team. Ms. O’Connor joined the firm in July 2007 from the United States Department of Justice, after six years as Assistant Attorney General for the Tax Division, a position to which President George W. Bush appointed her, and the Senate confirmed her, in 2001. From its inception in July 2002 until she left the Department, Ms. O’Connor was a member of the President’s Corporate Fraud Task Force.

As head of the Tax Division, Ms. O’Connor oversaw the litigation—civil and criminal, trial and appellate—of its approximately 350 attorneys. Significant litigation during this time included, among other things, hotly-contested and high-profile trials concerning the promotion and use of corporate and individual tax shelters. In addition to supervising the Tax Division’s litigation, Ms. O’Connor personally represented the United States in oral argument before the United States Supreme Court and the United States Courts of Appeals for the Fifth and Federal Circuits. To stem the rising tide of tax fraud, while preserving the possibility of the defendants' eventual indictment and conviction, in 2001, Ms. O'Connor created and implemented a program to coordinate civil and criminal investigative and judicial proceedings. The program continues to this day, and, under her leadership, resulted in the Tax Division’s obtaining more than 240 injunctions from United States District Courts across the country.

At the conclusion of her service with the Department of Justice, the Attorney General awarded Ms. O’Connor the Edmund J. Randolph Award for Outstanding Service, the Department’s highest award. The award is named for the first Attorney General and recognizes outstanding contributions to the accomplishment of the Department’s mission. The Commissioner of the Internal Revenue Service and the IRS Chief Counsel also bestowed their highest awards to Ms. O’Connor at the conclusion of her service in recognition of her contributions to the federal tax system.

Early in her career, Ms. O’Connor was a corporate tax law specialist with the National Office of the Internal Revenue Service. And for more than 20 years, Ms. O’Connor, who is also a CPA, was a national tax consultant with several top national accounting firms. She has taught in the graduate tax law program of Georgetown University School of Law, and was Distinguished Adjunct Professor of Tax Policy at the George Mason University School of Law.

Ms. O’Connor has long been a frequent speaker at bar conferences and business seminars. She recently designed and organized a one-day tax policy conference titled “Our Nation’s Founding Principles and Our Tax Code – Consistent or In Conflict?” sponsored by The Federalist Society.

Valerie Sasaki, a 2002 tax program alum, will be on campus to talk with students about their job search and effective ways to get the job you want. Valerie worked in the Portland office of KPMG in their State and Local Tax practice before moving to Miller Nash. She was the youngest president of the Oregon Tax Section and has several years of mentoring students. The presentation will be on Wednesday, May 11 at noon in room 115B-C. Pizza will be served. WSBA Tax Section Annual Luncheon

Washington State Bar Tax Section Annual Luncheon

All current students in the Tax Program are cordially invited to attend the Annual Luncheon meeting of the Washington State Bar Association's Taxation Section. The luncheon will be held on Tuesday, May 24, from 11:30 - 1:30 at the Columbia Tower Club (75th floor of the Bank of America Tower, 701 Fifth Avenue). This year's guest speaker will be Brett A. Weaver, Partner-in-Charge of KPMG Western Area International Corporate Services.

The $45 registration fee pays for everything, including tax and tip. Because we want to have a nice showing of Tax Program students at this event, the Tax Program will pay your $45 registration fee if you register with Allison Blahna by Wednesday, May 11. When you register with Allison (ablahna@uw.edu) be sure to indicate your choice of meal: Roasted Beef Tenderloin, Grilled Mahi Mahi, or Pecan Pesto Pasta (vegetarian).

This event is always a good opportunity for connecting with other practicing tax attorneys in the Puget Sound region. Business attire is required, as the Columbia Tower Club has a dress code. You will be denied entrance to the club if you arrive in casual attire.

The two-year LL.M. program includes coursework in clinical pedagogy and public interest law, as well as development by each LL.M. fellow of a project designed to effect system change, accompanied by a scholarly work of publishable quality.

LL.M. candidates will work under the supervision of the Law School’s experienced faculty to supervise and teach J.D. students enrolled in our clinics.

The program will begin in August, 2011. LL.M. candidates will receive a stipend of $49,667, plus health benefits.

Juvenile and Special Education Law Clinic
Took Crowell Institute for At-Risk Youth


Clinic faculty and law students represent children and parents of children in special education, school discipline, delinquency, and Medicaid matters. Its nationally- acclaimed approach supplements traditional delinquency defense with, where appropriate, advocacy to address the special education needs of children who are facing delinquency charges. The newly established Took Cromwell Institute for At-Risk Youth has enhanced the Clinic’s ability to do systemic reform work.

Candidates should be a member of the DC Bar, preferably with at least two years experience representing children charged in delinquency matters. Experience handling school discipline, special education, and Medicaid matters is desirable.


Low-Income Taxpayer Clinic

The Clinic represents taxpayers who have active tax controversies pending with the IRS, in U.S. Tax Court or state and local tax jurisdictions. The Clinic’s client-centered counseling approach often results in finding solutions that avoid trial and places clients on more sound financial footing.

Candidates should have two years relevant practice experience and be a member of the Bar of the District of Columbia.


Housing and Consumer Law Clinic

The majority of the Clinic’s work involves representation of individuals and small groups in affirmative habitability actions, illegal rent increase, eviction, predatory loan, foreclosure, and fair housing matters. The Clinic also handles cases on behalf of
consumers against merchants, and homeowners against contractors, in disputes involving sales and services.

Entrepreneurial Law Clinic

If you are interested in getting transactional tax experience, the Entrepreneurial Law Clinic (ELC) has several client matters that may interest you. The ELC provides critical early stage legal and business counseling to the following groups:

* Technology Entrepreneurs
* Small Business Owners
* Social Entrepreneurs & Non-Profits
* UW & Institute for Translational Health Sciences Faculty Researchers

The services of the ELC center on providing a business with a comprehensive “legal and business audit” that will help it identify issues before they become serious problems. The ELC provides clients with a confidential report ("audit memo"), generally at the end of the academic quarter in which an entrepreneur or business becomes a client. As a volunteer for the ELC, you would be responsible for addressing the tax issues in the audit memo. You would also have the opportunity to work with a supervising tax attorney and expand your network of contacts within the Seattle legal community.
